Jay-Z scored a huge legal victory as a judge allowed him to file for dismissal of the rape case, citing a critical procedural argument.
The case involves allegations from a woman who claims the rapper assaulted her in 2000 when she was just 13 years old.
On Thursday, Jan. 2, Judge Annalisa Torres of the Southern District of New York allowed Jay-Z’s lawyer, Alex Spiro, to argue that the lawsuit is a mistrial, according to court documents reported by X (formerly Twitter) reporter Meghan M. Caniff. was shared by .
Spiro pointed out that the New York City Gender-Motivated Violence Protection Act (GMV Law) did not go into effect until December 2000, three months after the alleged incident.
“Plaintiff cannot recover as a matter of law because the statute does not have retroactive effect,” Sparrow wrote in his letter to the court. The law was also amended in 2022 to allow historical claims, but Sparrow argued that does not change its original limitations.
The woman, identified as “Jane Doe,” has alleged that Jay-Z and Sean “Diddy” Combs assaulted her at the MTV Video Music Awards afterparty. Both the stars deny these claims.
Doe’s attorney, Tony Busby, disagreed with the motion to dismiss, arguing that the law is meant to help victims, not stop them.
Jay Z’s motion to dismiss is due Feb. 6, with responses by Feb. 28 and a response by March 14.
The legal battle isn’t over yet, but the decision is a big step in Jay-Z’s defense.
