ISLAMABAD: Another petition challenging the 26th Amendment was filed in the Supreme Court on Wednesday seeking a declaration that the Act violates the salient features of the Constitution.
This application was filed by former President of Lahore High Court Bar Association Tawfiq Asif under Article 184 (3) of the Constitution through Secretary Law and Justice, Secretary Defense, Judicial Commission of Pakistan (JCP) as well as Registrar of Supreme Court. Who was as respondents.
The petitioner requested the apex court to constitute a full court to hear the instant petition as well as other petitions challenging the 26th Amendment.
The petitioner contended that the Supreme Court, while hearing their constitutional petition earlier in 2014, had said that no amendment or legislation can be made which violates the basic structure of the Constitution.
Therefore, the petitioner pleaded with the Supreme Court that in view of its past judgment, the Court should declare the Act as contrary to the salient features of the Constitution and also strike it down.
He said that all the judges of the Supreme Court have taken an oath to protect the Constitution. Therefore, they were competent to hear petitions challenging the 26th Amendment.
