If they have failed to take action against misleading candidates, court action has been taken against them. A bench of Sattabmi Abhay Soka and Ujwal Bhuiyan examined the note submitted by advocate Shadan Farast and observed that several states were not following the relevant guidelines.
The bench said, “We make it clear that if we find that the relevant instructions of a state territory are not being implemented, we have to take legal action against any court under the state/central administration. Proceedings have to be initiated under the Centre’s “Rules of 1971”.
